SmartStop understands the importance placed by our customers and visitors on the privacy and security of their Personal Information (defined below).  This privacy policy (“Privacy Policy”) explains how SmartStop (“we,” “us,” or “our”), collects, uses, shares, and protects your Personal Information whenever you access or use our products and services such as visiting our website ("Website"), mobile app (“App”), or using our storage services (collectively, the “Services”).

This Policy only applies to SmartStop and its Services and not to websites, apps, or services of any other company or organization, including those linked to or through the Website or App, which may have different policies. 1. Personal Information We Collect About You

Personal Information generally means information that identifies you.  When you interact with us, we may ask you to supply us with Personal Information so that we can provide, enhance, and personalize our Services and marketing efforts.

SmartStop collects Personal Information that you directly provide to us such as your name, address, telephone number, and email address. This information may be provided to us when you reserve a storage space, enter into a rental agreement, pay a rental invoice, or purchase supplies. 

SmartStop also collects certain types of information automatically when you visit the Website or App, such as your IP address and device location. 

We might also collect non-personal and aggregate information about the use of the Website or App, such as page hits, number of visits, web pages viewed, and the length of visits. We do not tie this non-Personal Information to your Personal Information.

 

2. How We Use Your Personal Information

We are committed to maintaining your trust, and we want you to understand when and with whom we may share information collected about you. We use your Personal Information to provide you with our storage and related Services as described below. We do not sell your Personal Information.  We will only keep your Personal Information for as long as necessary to fulfill the purposes for which we collect the information, as described in this Privacy Policy, unless a longer retention period is required or permitted by law.

2.2 With Your Consent

With your consent, we may share your Personal Information with third-party business partners and others included in the notice we gave to obtain your consent.

2.3 Authorized Service Providers and Contractors

We share your information with service providers and contractors for business purposes to help us with specialized services such as customer support, email and text message deployment, business analytics, marketing, and data processing. For example, billing information we collect from you is automatically transferred to our e-commerce solutions provider through a “Secure Socket Layer Web Service” in order to process a bill payment or purchase order. Such provider does not use this information other than to process your payment or order. Your information also may be viewed or maintained by outside vendors such as auditors, consultants, or others as part of the services they provide to us.

2.4 Google Analytics and Google AdWords 

We use Google Analytics on our Sites to help us analyze traffic and improve services. For more information on Google Analytics’ processing of Personal Information, please see http://www.google.com/policies/privacy/partners/.  You may opt out of the use of Google Analytics here: https://tools.google.com/dlpage/gaoptout.  

We also use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to our Website or App.  Any data we collect will be used in accordance with this Privacy Policy, and Google is responsible to abide by its own privacy policy. 2.5 Business Transfers

We reserve the right to transfer information about you to a successor organization if, for example, we transfer the ownership of some or all of our assets, enter bankruptcy, or merge with another organization. If such a transfer occurs, we will use reasonable efforts to direct the transferee to use Personal Information in a manner consistent with this Privacy Policy.

2.6 Legal Requirements

We may disclose information about our customers, including contact information, to respond to subpoenas, court orders, legal process, and other law enforcement measures, and to comply with other legal obligations.

2.7 Protecting Our Sites and Users

If we believe that anyone’s use of the Services may damage us, our Services, or any person or property, we may use or disclose relevant Personal Information to prevent such harm. We also may disclose information about you when we, in good faith, believe disclosure is appropriate in order to: prevent or investigate a possible crime, such as fraud or identity theft; protect the security of our Website or App; enforce or apply our Terms and Conditions or other agreements; or protect our own rights or property or the rights, property, or safety of our customers or others.

2.8 Non-Personal Information

We may share non-personal Information for any reason. Likewise, we may share anonymized information (information that has had all data identifying an individual removed) with third parties, including to help us develop content and services we hope you will find of interest. This sharing of anonymized information will not include Personal Information.

 

3. SmartStop’s Security Measures

We maintain certain security measures, including industry-standard electronic, physical, and procedural safeguards, to protect the security of your Personal Information. While we believe that our security measures are reasonable and appropriate, the storage, use, and transmission of information over the internet can never be made 100% secure. Consequently, we do not warrant the security or confidentiality of your Personal Information, and you provide such information to us at your own risk. By providing Personal Information to us, you agree that we can communicate with you electronically regarding security and other issues relating to your use of the Website, App, or your account with us. If there is a breach of our security measures, we may attempt to notify you electronically at the most current email address you have provided to us or by other means so you can take appropriate actions, but we are not committing to do so except as may be required by law. We may also post a notice of a security breach on the Website or App. Unless you indicate otherwise, we may notify you using the most current email address you provided to us.

 

4. Cookies and Similar Technologies

4.1 Internet “Cookies”

We may use internet technologies to collect information and track how visitors use the Website or App.  Cookies are pieces of information that a website transfers and stores on a visitor’s personal computer in order to store information about the visitor’s preferences, which such website can later retrieve. We may use cookies for certain limited purposes such as storing your preferences or your password so that you do not have to input it each time you use the Website or App.  

The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. 4.2 Do Not Track

Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time, which means that we collect information about your online activity while you are using our Services. 

4.3 Apps

When you download or purchase an App developed by us, you may do so through a third-party application online store such as Apple’s App Store. When downloading an app or using an app with on-line features through your platform, the app provider will typically also collect certain device and app-related information. We do not control the requirements or policies of app stores. 5. Live Chat

We utilize a live chat service provided by a third party vender that collects, uses, stores, shares, discloses, and protects customer information. The data the third party vender stores from our customers is strictly for our use. Information can include operator names and emails, visitor names and emails, visitor phone numbers, email addresses, and IP addresses. There will also be cookies and local storage kept on the third party vender’s servers to help provide site history of our Website and App visitors.

 

6. Governing Law and Notice to Non-US Users

Our company is controlled and operated in the United States and Canada, and use of our Services is only intended for customers in the United States and Canada.  If you are located outside of the United States and Canada, please do not use the Services. By utilizing the Services, you acknowledge and consent to the transfer to and processing of your Personal Information in the U.S. and/or Canada. By using SmartStop’s Services, you authorize SmartStop to collect and use your Personal Information in accordance with the laws and regulations of the United States and Canada, which may not be as protective or comprehensive as those in your home jurisdiction.

 

7. How to Change Your Personal Information

If you have an online account with us, you can update your information by accessing your account directly. You also may update or amend your information by contacting us at any of the addresses provided in Section X below. It is our goal to make all reasonable efforts to correct your Personal Information from the SmartStop active database or discontinue the use of your Personal Information, if requested. For California residents, you may also make requests as described in Section VIII below.

 

8. Updates to The Privacy Policy

We reserve the right to change, modify, amend and/or update this Privacy Policy at any time with or without prior notice at our sole and absolute discretion to the extent permitted by law. Your access or use of SmartStop’s Services following the effective date of any such changes constitutes your unconditional agreement to follow and be bound by such changes. You are responsible for reviewing this Privacy Policy each time you use or access the Website or App.  If you do not agree to the modified provisions of this Privacy Policy, then you should discontinue your access and use of the Services.

 

9. Privacy of Minors

The Services are not intended for use by children. 10. Privacy Notice and Disclosures for California Residents

This section applies solely to the Personal Information of users who reside in the State of California and supplements the information contained in the rest of this Privacy Policy.

10.1 Rights Provided by California Civil Code Section 1798.83

Under California’s “Shine the Light” law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (a) a list of the categories of Personal Information, such as name, e-mail, mailing address, and type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the names and addresses of all such third parties.

10.2 Rights Under the California Consumer Privacy Act

This section provides additional information for California residents under the California Consumer Privacy Act (“CCPA”) and any effective amendments thereto.  The terms used in this section have the same meaning as those used in CCPA. This section does not apply to information that is not considered “Personal Information” under CCPA such as anonymous, deidentified, aggregated, or public information.

10.3 Personal Information Collected

The chart below describes the Personal Information we have collected, used, and disclosed in the past 12 months.  We do not “sell” any Personal Information as that term is defined under the CCPA.

The business or commercial purposes of collection, use, and disclosure include: 

  • Auditing relating to a current interaction with you, including but not limited to counting ad impressions, verifying positioning and quality of ad impressions, and compliance.
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  • Debugging to identify and repair errors that impair existing intended functionality.
  • Performing services on behalf of ourselves or a service provider or contractor, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, providing advertising or marketing services, providing analytic services, or providing similar services.

10.4 Right to Access

10.5 Right to Correct

Beginning January 1, 2023, California residents will have the right to correct inaccuracies in your Personal Information that we have collected, taking into account the nature of the Personal Information and the purposes of processing the Personal Information.  To submit a request under your Right to Correct, contact us using the information provided below in Exercising Your CCPA Rights.

10.6 Right to Delete

California residents have a right to request the deletion of their Personal Information collected or maintained by SmartStop. To submit a request under your Right to Delete, contact us using the information provided below in Exercising Your CCPA Rights.

10.7 Right to Opt Out

In the preceding 12 months, SmartStop has not sold Personal Information of California residents for monetary payments.  However, like many companies, we do use services that help deliver interest-based ads to you and we may transfer Personal Information to business partners for their use.  Because the definitions of ‘Personal Information,’ ‘share,’ and ‘sale’ under CCPA are broad, making Personal Information available to these companies may be considered a “sale” or “sharing” under CCPA.  You can opt out of such “sale” or “sharing” here: Do Not Sell or Share My Information.

10.8 Right to Non-Discrimination 

California residents have a right to not receive discriminatory treatment by SmartStop for exercising any of your privacy rights under the CCPA. SmartStop will not discriminate against any California consumer because such person exercised any of the consumer’s rights under CCPA, including, but not limited to: (i) denying goods or services, (ii) charging different prices or rates for goods and services, including through the use of discounts or other benefits or imposing penalties, (iii) providing a different level or quality of goods or services, (iv) suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services. SmartStop may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided to SmartStop by your data.

10.9 Authorized Agents

You may designate an authorized agent to make a request under the CCPA on your behalf. We will deny requests from agents that do not submit proof of authorization from you. To verify that an authorized agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us.

10.11 Verification and Response Process 

When you make a request under your “Right to Access” “Right to Correct,” or “Right to Delete,” you can expect the following:

  1. Verification: We will verify your identity. You will need to provide us the following: (i) sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
  2. Confirmation: We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us using one of the methods described at the end of this section under the heading “CCPA Requests.”
  3. Response: We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  4. Denials: In certain cases, a request to access, correct, or delete may be denied. For example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order. 

We may also deny a request for deletion if it is necessary for us or a service provider or contractor to maintain your Personal Information in order to:

  • Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us.
  • Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
  • Debug to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another customer to exercise their right of free speech, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act.
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent.
  • Enable solely internal uses that are reasonably aligned with your expectations based on our relationship.
  • Comply with a legal obligation.
  • Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

If we deny any of your requests, we will explain why we denied it.  If there is a portion of your request that we can comply with, for example deleting some of the requested information, then we will do so.
